1. Provider

These terms govern the commercial use of Spendemon, provided by:

2. Subject matter

Spendemon is a self-hosted software application for visualising Kubernetes workload costs from Prometheus metrics. A commercial subscription grants you a license to use Spendemon in a commercial context in accordance with the Spendemon license.

Prices are in USD and exclusive of any applicable taxes (e.g. Swiss VAT where applicable). Subscriptions are billed monthly and renew automatically until cancelled.

4. License grant

Upon payment of the applicable subscription fee, you are granted a non-exclusive, non-transferable license to use Spendemon for commercial purposes within the limits of your plan. You may not sublicense, resell, or redistribute Spendemon as part of a commercial offering without a separate written agreement.

5. Payment

Payments are processed by Stripe. By subscribing you agree to Stripe's Terms of Service. You authorise us to charge your payment method on a recurring monthly basis until you cancel.

6. Cancellation

You may cancel your subscription at any time through the Stripe customer portal or by contacting us at tavernini.online/contact. Cancellation takes effect at the end of the current billing period. You retain access to Spendemon under the commercial license until the end of the period you have paid for.

7. No warranty

Spendemon is provided "as is" without warranty of any kind (Art. 197 ff. OR excluded to the extent permitted by law). We do not guarantee uninterrupted availability or fitness for a particular purpose.

8. Limitation of liability

To the maximum extent permitted by Swiss law, our total liability for any claim arising from these terms or your use of Spendemon is limited to the amount you paid in the three months preceding the claim. Liability for intentional acts or gross negligence remains unaffected.

9. Changes to these terms

We may update these terms from time to time. Continued use of a paid subscription after notice of changes constitutes acceptance of the updated terms. We will notify subscribers by email of material changes.

10. Governing law and jurisdiction

These terms are governed exclusively by Swiss law (excluding conflict of law rules and the Vienna Convention on the International Sale of Goods). The place of jurisdiction for any disputes is Schaffhausen, Switzerland.
